Our Creditors’ Rights practice is focused on protecting and maximizing recoveries for creditors across the full spectrum of debtor-creditor issues, industries, and business sizes. Clients include lenders, trade creditors, farmers, sellers, buyers, investors, and other stakeholders. We represent secured and unsecured creditors from initial demand and negotiated workouts through end-game litigation, foreclosure actions, receiverships, Article 9 remedies, and related enforcement proceedings.

We also help clients plan ahead by structuring new credit extensions, forbearance agreements, intercreditor arrangements, and security packages with an eye toward what happens if the debtor becomes distressed or files bankruptcy. Drawing on deep knowledge of debtor-creditor law and bankruptcy procedure, we provide practical, business-oriented strategies to preserve collateral value, limit risk, and position our clients for the best possible outcome in or out of court.
